Visa Cancellation/ Refusal
The Australian Department of Home Affairs may cancel a visa or refuse a visa application under several grounds. These include, but not limited to character, health, false or misleading information, failing to meet visa conditions, risk to community, change in circumstances and failure to respond to a cancellation notice.
Depending on the visa type and reason for cancellation or refusal, you may be able to appeal the decision to the Administrative Appeals Tribunal (AAT) within certain period noted in the Department’s letter. Upon application to AAT, a member of the AAT will review the decision and decide as to whether the decision is correct. If your visa application has been refused or you have received a notice of cancellation notice, you must immediately contact your lawyer or migration agent. Refusal of Citizenship Application
The Australian Department of Home Affairs may refuse a citizenship application under several grounds. Theses include failing to meet residency requirements, failing to satisfy character requirements, insufficient knowledge of English, failing the citizenship test, incomplete or misleading information or failing to prove intention to reside.
Depending on the circumstances, you may be eligible to appeal the decision to the Administrative Appeals Tribunal (AAT) within specific timeframe noted in the Department’s letter. If your citizenship application has been refused, you must immediately contact your lawyer or migration agent.
